These Terms of Service govern your access to and use of FieldOpsX Pro, including the FieldOpsX Pro mobile application, website, features, integrations, and related services. By creating an account, starting a free trial, purchasing a subscription, or using FieldOpsX Pro, you agree to these Terms. If you do not agree to these Terms, do not use FieldOpsX Pro.
This page also functions as the FieldOpsX Pro End User License Agreement and Terms of Use.
1. FieldOpsX Pro
FieldOpsX Pro is field service management software designed to help service businesses manage activities such as scheduling, customer records, jobs, routing, quotes, parts, invoices, payments, expenses, accounting synchronization, communications, and business records.
FieldOpsX Pro provides software tools only. You remain responsible for how you operate your business and for reviewing the accuracy of information created, entered, calculated, sent, synchronized, or stored through the service.
2. Eligibility and Account Responsibility
You must be at least 18 years old and legally able to enter into a binding agreement to use FieldOpsX Pro. If you use FieldOpsX Pro on behalf of a company or other business, you confirm that you have authority to accept these Terms on behalf of that business.
You are responsible for:
- Keeping your account and device secure.
- Protecting passwords, authentication credentials, API tokens, and connected-service credentials.
- Activities performed through your account.
- Keeping your account information accurate.
- Preventing unauthorized access to your account.
You must notify us if you believe your account or connected services have been accessed without authorization.
3. 30-Day Free Trial
FieldOpsX Pro includes a 30-day free trial for eligible new users. There is no charge for using FieldOpsX Pro during the free trial. Starting a free trial does not by itself create a paid subscription. To continue using paid FieldOpsX Pro features after the trial ends, you must select and activate a paid subscription. We may limit repeated or abusive attempts to obtain additional free trials. Features available during the trial may be changed as the service develops.
4. Subscription Plans
FieldOpsX Pro currently offers the following subscription options:
Monthly Plan: $30 per month
Annual Plan: $300 per year
The currency applicable to your purchase will be displayed before payment or at checkout. Applicable taxes may be added to the subscription price where required by law. Subscription fees are charged at the beginning of each applicable billing period. Monthly subscriptions renew monthly unless canceled. Annual subscriptions renew annually unless canceled.
We may change subscription pricing in the future. Any pricing change will apply to a future renewal and will not change the price of a billing period that has already been paid. Where appropriate, we will provide notice before a pricing change takes effect.
5. Cancellation
You may cancel your subscription at any time. If you cancel a monthly subscription, you will not be charged for the next monthly billing cycle. If you cancel an annual subscription, you will not be charged for the next annual renewal. You may continue using your paid subscription until the end of the period you already paid for. Cancellation stops future renewal charges. It does not create a refund for the current billing period.
6. Refund Policy
All FieldOpsX Pro subscription payments are non-refundable, except where a refund is required by applicable law. This includes monthly and annual subscription fees, unused portions of a billing period, partial billing periods, and voluntary cancellation before the end of a paid billing period. Canceling a subscription prevents future renewal charges but does not refund payments already made. Nothing in these Terms removes any consumer right that cannot legally be waived.
7. Taxes on Your FieldOpsX Subscription
Subscription prices may be subject to sales tax, GST, HST, VAT, or other taxes depending on your location and applicable law. Where FieldOpsX Pro is legally required to collect tax on its subscription fees, the applicable tax may be added to your subscription charge. You are responsible for providing accurate billing and location information where required for tax purposes.
8. Taxes You Charge Your Customers
FieldOpsX Pro may allow you to enter, save, edit, calculate, display, or apply taxes to quotes, invoices, expenses, or other business records. You are solely responsible for determining the correct taxes and tax rates that apply to your business and your customers.
Tax requirements can vary significantly by country, state, province, county, municipality, city, product, service, customer, transaction type, exemption status, and other factors. FieldOpsX Pro does not provide tax, accounting, or legal advice and does not guarantee that a tax rate entered, displayed, saved, copied, suggested, previously used, or synchronized through the service is correct or current for a particular transaction or location.
You are responsible for:
- Determining whether tax should be charged.
- Entering the correct tax rate.
- Selecting the correct tax jurisdiction.
- Applying exemptions correctly.
- Verifying tax amounts before sending quotes or invoices.
- Filing tax returns.
- Remitting taxes to the appropriate government authority.
- Maintaining records required by applicable tax law.
Any tax-related settings or calculation tools provided by FieldOpsX Pro are business tools and do not replace your responsibility to verify the applicable tax treatment. You should consult a qualified tax professional when necessary.
9. Customer, Job, Quote, Invoice, Payment, and Expense Records
You are responsible for reviewing business records before relying on them or sending them to customers, accounting systems, payment services, or other third parties. This includes customer information, addresses, service details, quotes, parts, labor, prices, discounts, taxes, invoices, payment records, refund records, expenses, accounting classifications, and account mappings.
FieldOpsX Pro may automate or simplify parts of these workflows, but you remain responsible for the final business record.
10. Accounting Integrations
FieldOpsX Pro may connect with third-party accounting services such as QuickBooks Online and Wave. These integrations are optional and depend on third-party APIs, account permissions, provider settings, mappings, internet availability, and services operated by those providers.
When you connect QuickBooks Online, you authorize FieldOpsX Pro to exchange selected business and accounting information with QuickBooks, including customers, invoices, invoice line items, payments, expenses, vendors or accounting references, taxes, account mappings, related identifiers, and other information needed for the features you request. QuickBooks Online is operated by Intuit and is subject to Intuit's own terms, privacy practices, availability, and account requirements. FieldOpsX Pro does not receive or store your Intuit password; Intuit handles sign-in and authorization. You can disconnect QuickBooks from FieldOpsX Pro.
You are responsible for reviewing synchronized information in your accounting system, including invoices, payments, refunds, expenses, customers, products, services, taxes, and account mappings. FieldOpsX Pro is software and does not provide accounting, tax, or legal advice. FieldOpsX Pro does not guarantee that a third-party accounting provider will accept, classify, display, modify, or process synchronized records in the same way FieldOpsX Pro displays them. Third-party providers may change their APIs, policies, features, pricing, permissions, or availability at any time.
11. Payment Services
FieldOpsX Pro may provide tools for recording payments or connecting customers with third-party payment options or payment providers. Unless specifically stated otherwise, FieldOpsX Pro is not the financial institution, payment processor, bank, or card network responsible for processing the underlying payment. Third-party payment services have their own terms, fees, availability, dispute processes, refund rules, and security requirements. You are responsible for verifying that a payment has actually been received before treating an invoice or customer account as paid.
12. Email, Text Messages, and Customer Communications
FieldOpsX Pro may help you prepare or send emails, text messages, quotes, invoices, payment reminders, arrival notifications, or other communications. You are responsible for ensuring that your communications comply with applicable laws and that you have any consent required to contact a customer. You are also responsible for reviewing messages before sending them. Email, SMS, cellular, and internet delivery can depend on third-party providers and cannot be guaranteed.
13. Maps, Routing, ETA, and Location Features
FieldOpsX Pro may use location information, mapping providers, navigation services, routing tools, or estimated travel times to support field service operations. Routes, travel times, arrival estimates, distances, and map information may be inaccurate or change because of traffic, road closures, weather, provider data, GPS accuracy, or other conditions. You are responsible for using appropriate judgment while driving and complying with traffic and safety laws. Do not interact with FieldOpsX Pro in a way that distracts you from safely operating a vehicle.
14. Parts and Inventory
FieldOpsX Pro may provide inventory, parts, ordering, receiving, and job-related parts tracking tools. Inventory quantities and part statuses depend on information entered or updated by the user. You are responsible for confirming actual stock, part compatibility, availability, pricing, ordering status, and received quantities. FieldOpsX Pro does not guarantee that inventory records reflect the physical inventory available to your business.
15. Professional and Business Responsibility
FieldOpsX Pro is a business management tool. It does not authorize you to perform any trade or professional service. You are responsible for maintaining any licenses, certifications, insurance, permits, qualifications, registrations, or approvals required for the services you perform, and for the safety, legality, quality, and completion of work performed for customers.
16. Data and Backups
You are responsible for maintaining appropriate copies and backups of important business information. FieldOpsX Pro may provide device backup, cloud backup, export, restore, or synchronization features. No electronic storage or backup system can guarantee against every possible loss, corruption, device failure, account problem, third-party outage, software error, or user error. You should periodically verify that important backups and exports are working correctly.
Before deleting the application, replacing or resetting a device, canceling your account, or making significant account changes, you should confirm that information you need has been safely backed up or exported.
17. Third-Party Services
FieldOpsX Pro may integrate with or link to services operated by other companies, including accounting, mapping, payment, email, cloud storage, app store, navigation, and other external platforms. Those services are controlled by their respective providers and are subject to their own terms and privacy policies. FieldOpsX Pro is not responsible for third-party outages, API changes, provider account restrictions or pricing changes, third-party data loss, feature changes, authentication failures, suspension or termination of third-party accounts, or actions taken by a third-party provider. We may modify or discontinue an integration if a provider changes or removes necessary functionality.
18. Acceptable Use
You may not use FieldOpsX Pro to:
- Violate applicable law.
- Commit fraud or assist fraudulent activity.
- Access another person's account without authorization.
- Attempt to bypass security protections.
- Introduce malware or malicious code.
- Intentionally interfere with the operation of the service.
- Abuse or overload FieldOpsX Pro infrastructure.
- Unlawfully collect, store, or distribute personal information.
- Copy, reverse engineer, decompile, or attempt to extract protected source code except where prohibited by law.
- Resell or redistribute FieldOpsX Pro without authorization.
19. Suspension or Termination
We may temporarily suspend or restrict access to FieldOpsX Pro when reasonably necessary to protect the service or its users, investigate suspected fraud or unauthorized access, prevent significant abuse, comply with a legal obligation, address unpaid subscription charges, or address a serious or repeated violation of these Terms. Where reasonably possible, we will attempt to provide notice and an opportunity to correct the issue before permanently terminating access. Immediate suspension may be necessary when continued access creates a security, legal, fraud, or safety risk.
You may stop using FieldOpsX Pro and cancel your subscription at any time. Termination or cancellation does not create a refund except where required by law.
20. Software License
Subject to these Terms and payment of applicable subscription fees, FieldOpsX Pro grants you a limited, non-exclusive, non-transferable, revocable right to use the software for your own lawful business purposes. FieldOpsX Pro and its software, branding, design, source code, workflows, graphics, documentation, trademarks, and other intellectual property remain the property of their respective owners. Your subscription provides access to the software; it does not transfer ownership of FieldOpsX Pro or its intellectual property to you.
21. Updates and Changes to the Service
FieldOpsX Pro may be updated, modified, improved, replaced, or changed over time. Features may be added, modified, redesigned, limited, or discontinued. We may release updates necessary for security, compatibility, legal compliance, accounting integrations, third-party API compatibility, bug fixes, or continued operation. We do not guarantee that every feature will remain unchanged indefinitely.
22. Service Availability
We work to keep FieldOpsX Pro available and functioning properly, but uninterrupted service cannot be guaranteed. The service may be unavailable because of maintenance, software updates, server or internet problems, cloud or third-party outages, API changes, security incidents, or events outside our reasonable control.
23. No Professional Advice
Information provided through FieldOpsX Pro is not legal, accounting, tax, financial, engineering, licensing, or professional advice. You are responsible for obtaining professional advice when appropriate for your business.
24. Disclaimer of Warranties
To the maximum extent permitted by law, FieldOpsX Pro is provided on an "as available" basis. We do not guarantee that the service will always be uninterrupted, error-free, completely secure, or suitable for every business situation. We do not guarantee the accuracy of information entered by users, supplied by third-party services, calculated from third-party information, or synchronized to external platforms. Nothing in this section excludes warranties or rights that cannot legally be excluded.
25. Limitation of Liability
To the maximum extent permitted by applicable law, FieldOpsX Pro will not be responsible for indirect, incidental, special, consequential, or similar business losses resulting from use or inability to use the service. This may include loss of profits, business opportunities, customer relationships, data, incorrect tax treatment or accounting records, missed appointments, routing problems, third-party service failures, or payment processing issues. Where liability cannot legally be excluded, FieldOpsX Pro's liability will be limited only to the extent permitted by applicable law. Nothing in these Terms limits liability that cannot legally be limited.
26. Changes to These Terms
We may update these Terms when FieldOpsX Pro, its business model, integrations, legal requirements, or services change. The current version will be posted on the FieldOpsX Pro website with an updated effective date. If a change materially affects an active paid subscription, we may provide additional notice where appropriate. Your continued use of FieldOpsX Pro after updated Terms become effective constitutes acceptance of the updated Terms, except where additional consent is required by law.
27. Governing Law
These Terms are governed by the laws of the Province of British Columbia and the applicable federal laws of Canada, without regard to conflict-of-law principles. Subject to rights or remedies that cannot legally be restricted, disputes relating to these Terms or FieldOpsX Pro will be subject to the courts located in British Columbia, Canada.
28. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in effect. Any invalid provision will be interpreted or limited to the minimum extent necessary to make it enforceable where permitted by law.
29. Entire Agreement
These Terms, together with the FieldOpsX Pro Privacy Policy and any additional terms presented when purchasing or using a specific service, form the agreement governing your use of FieldOpsX Pro.
30. Contact
Questions about these Terms can be submitted through the FieldOpsX Pro Support page.
